Neshpal Real Estate Terms and Conditions

“Services” – refers to property sales, leasing, marketing, consultancy, advisory, and any other related services provided.
2. Scope of Services

Neshpal Real Estate acts as a property consultant, agent, and advisor, facilitating transactions between property owners, developers, and prospective tenants or buyers.

We do not guarantee the completion of any transaction, as final agreements are subject to third-party approvals (e.g., landlords, developers, financiers, and government regulators).
3. Property Listings & Information

All property details provided (e.g., floor area, pricing, availability, specifications) are based on information supplied by landlords, developers, or sellers.

While we make every effort to ensure accuracy, Neshpal Real Estate does not warrant or guarantee that all information is complete, up-to-date, or free from errors.

Clients are encouraged to conduct independent due diligence before making decisions.
4. Fees & Payments

Our consultancy, agency, or brokerage fees will be communicated in writing prior to engagement.

All fees must be paid as per agreed timelines. Late payments may attract penalties.

Service charges, taxes (including VAT), and third-party costs are the responsibility of the client, unless otherwise agreed in writing.
5. Client Responsibilities

Clients must provide accurate and complete information when engaging Neshpal Real Estate.

Clients must comply with applicable laws, regulations, and contractual obligations relating to property ownership, leasing, and transactions.

Any fraudulent, misleading, or incomplete disclosure by the client will be deemed a breach of these terms.
6. Confidentiality & Data Protection

We respect client confidentiality and handle all personal and business information in line with Kenya’s Data Protection Act, 2019.

However, information may be shared with landlords, developers, legal advisors, or relevant authorities where necessary to facilitate a transaction.
7. Liability Disclaimer

Neshpal Real Estate is not liable for:

Market fluctuations affecting property value.

Decisions made by landlords, developers, or financiers.

Delays caused by government approvals or legal processes.

Any indirect, incidental, or consequential losses.

Our liability is limited strictly to the value of consultancy fees paid to us by the client for the specific transaction in question.
8. Intellectual Property

All website content, branding, brochures, and marketing material created by Neshpal Real Estate remain our intellectual property.

Clients may not reproduce, copy, or distribute such materials without prior written consent.
9. Termination of Engagement

Either party may terminate the engagement with written notice.

Any fees due up to the date of termination remain payable.

Termination does not affect accrued rights or obligations.
10. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of the Republic of Kenya.

Any disputes shall be subject to arbitration in Nairobi, in accordance with the Arbitration Act (1995), before resorting to court litigation.
11. Amendments

Neshpal Real Estate reserves the right to update these Terms & Conditions at any time. Changes will be communicated via our website or official correspondence.
